1. About these terms

the OFNIR mobile app and the OFNIR admin panel are provided by OFNIR Constructions (Pvt) Ltd of Jaffna, Sri Lanka. These terms are an agreement between you and that company about how you may use the software.

They sit alongside your contract of employment and the company’s internal policies. Where these terms and your employment contract say different things about the same subject, your employment contract prevails.

2. Who may use the software

This is internal business software, not a public service. You may use it only if the company has issued you an account, and only for the company’s work. There is no public sign-up, and accounts are not transferable.

3. Your account

4. Acceptable use

You must not:

Misuse may lead to your access being withdrawn and to action under the company’s disciplinary procedure, and — where the conduct warrants it — to referral to the authorities.

5. Attendance and location monitoring

Attendance in this app is confirmed by location. While you are checked in to a site, the app records where the device is, so the company can be satisfied that attendance was marked at the site claimed. It does not do this outside an active check-in.

What is collected, and for how long, is set out in our privacy policy. You may refuse or withdraw location permission on your device; if you do, geofenced check-in will not work and your attendance will need to be recorded and approved another way.

6. Company records and ownership

The records you create through the software — attendance, purchases, stock movements, photographs of goods and invoices, work logs and the rest — are the company’s business records, and the company owns them. The software itself, its design and its content remain the property of OFNIR Constructions (Pvt) Ltd and its licensors.

Your own personal information within those records remains subject to the privacy policy, including your right to ask for a copy or a correction.

7. Availability

We try to keep the software available and working, but we do not promise that it will be uninterrupted or error-free. It may be unavailable during maintenance, during network or power failures on site, or for reasons outside our control. We may change, suspend or withdraw features at any time.

If the app is unavailable when you need to record something, tell your supervisor and follow the company’s fallback procedure.

8. Accuracy of what you enter

The software records what it is given. You are responsible for the accuracy of what you enter — quantities, amounts, invoice numbers, hours and photographs — and for correcting it promptly through the proper route if you find a mistake. Records that affect pay or the accounts may be locked once other records depend on them, and can then only be corrected by the office.

9. Suspension and ending access

The company may suspend or withdraw your access at any time, with or without notice, including where it believes these terms have been broken, where an investigation requires it, or when your employment ends. Withdrawing access does not remove the records already made — those remain the company’s.

10. Liability

The software is provided for the company’s internal use as it stands. To the fullest extent the law allows, we are not liable for indirect or consequential loss arising from your use of it, or from its being unavailable.

Nothing in these terms limits any liability that cannot lawfully be limited, excludes your rights as an employee, or affects the company’s obligations under employment or data-protection law.

11. Governing law

These terms are governed by the laws of Sri Lanka, and the courts of Sri Lanka have jurisdiction over any dispute arising from them.

12. Changes to these terms

We may update these terms. When we do, we will change the date at the top of this page, and where a change is significant we will tell you through the app. Continuing to use the software after a change means you accept the updated terms.
